Terms and conditions of buying from The Herb Ladies (Gerda Gesondheid)

 

 

The Buyer accepts and agrees that:

1. The Seller will only supply Products under these Terms and Conditions, which are conclusive and non-negotiable.


2. The Buyer confirms that they will only use the Products under the guidance of their physician (where applicable) or licensed health professional (where relevant).


3. The Seller does not offer medical advice. All information is supplied on an educational basis and should not be construed to replace that of a physician.


4. All translations are offered on a best effort basis. Any opinions stated are not necessarily those of the Seller. Where applicable, material is distributed to those who have expressed a prior interest in receiving the information for research and educational purposes.


5. The Seller makes no warranties, whether expressed or implied, with regard to any of the Products sold.


6. The Seller specifically does not make any medical claims for the Products. The Buyer will be advised as to which products will be to the Buyer's best benefit, based on the Seller's experience. If the Buyer insists on buying products not suitable, the Seller cannot be held responsible for any side-effects or interfering with medical conditions or prescription medicine. Although the products are 100% natural, some herbs and spices might clash with certain medications or medical conditions, therefore the Buyer will be advised accordingly.


7. In the event of an officially confirmed mailing loss the Products will be shipped for a second and final time. If a further mailing loss occurs then a refund will be issued.


8. The Seller assumes no responsibility whatsoever for the use of any of the Products sold. If the Buyer insists on buying products not suitable, the Seller cannot be held responsible for any side-effects or interfering with medical conditions or prescription medicine. Although the products are 100% natural, some herbs and spices might clash with certain medications or medical conditions, therefore the Buyer will be advised accordingly.


9. The Buyer accepts full responsibility and liability for the use of the Products and services supplied by the Seller and will not hold The Seller liable for any damages suffered whatsoever, whether direct or consequential. If the Buyer insists on buying products not suitable, the Seller cannot be held responsible for any side-effects or interfering with medical conditions or prescription medicine. Although the products are 100% natural, some herbs and spices might clash with certain medications or medical conditions, therefore the Buyer will be advised accordingly.


10. The Seller reserves the right to alter methods of shipment or to refuse orders.


11. If the Seller has shipped the wrong products or products have arrived in a damaged condition due to incorrect packaging, then the Seller must be contacted first and then the package and products must be returned to the Seller for inspection. If the fault is identified and agreed, the Seller will reship the Products.


12. Subject to availability and receipt of payment, orders will be processed MORE OR LESS 5-21 WORKING days and delivery confirmed by way of email or whatsapp. NB: This is only a guideline and could possibly take longer (up to 21 working days, depending on my herb and oil suppliers). If the client insists on quicker delivery, there will be an extra cost of R1500. If the client is not happy with this, and cancels the order before the products have been sent, please note that cancellation of orders by the client will attract a R100.00 administration fee. Refunds will take APPROXIMATELY 21 working days.

The Company will deliver the Goods to you as soon as reasonably possible, but no later than 30 days of receipt of your payment (“Delivery Period”). We will notify you if we are unable to deliver the Goods during the Delivery Period. You may then, within 7 days of receiving such notification elect whether or not to proceed with your order for the Goods. If you elect not to proceed with your order, we will reimburse you with the purchase price within 30 days of having informed you that we are not able to deliver the Goods during the Delivery Period.


13. The provision of goods and services by the Seller is subject to availability. In cases of unavailability, the Seller will refund the client in full within APPROXIMATELY 21 days. Cancellation of orders by the client will attract a R100.00 administration fee. Refunds will take APPROXIMATELY 21 working days.

15. The Buyer warrants that they hold the Seller free of any and all legal action and prosecution. This includes any entrapment procedures that may be perpetrated or attempted by law enforcement and government agents and/or their agencies.


16. Due to the continuous strikes by the post office, the Seller will make use of a Courier service of their choice. UNDER NO

CIRCUMSTANCES WILL THE POST OFFICE EVER BE USED. PEP COURIER OR ARAMEX WILL NOT BE USED, only the seller's choice of courier who can collect and deliver door to door.


17. If you do not supply your FULL PHYSICAL ADDRESS & POSTAL CODE & CONTACT NUMBER, the seller takes no responsibility if your parcel is delayed or delivered at the incorrect address. Every time an email is sent to ask for information not supplied as requested, the order may be delayed by up to a week. If the info has still not been received after various emails, the parcel will be sent without it, and the seller takes NO responsibility for any losses. If the client cancels the order due to this reason (information not supplied as requested) cancellation of orders by the client will attract a R50.00 administration fee.  Refunds will take APPROXIMATELY 21 working days.


18. OWN COURIER SERVICE NOT ALLOWED. PEP COURIER OR ARAMEX WILL NOT BE USED, only the seller's choice of courier who can collect and deliver door to door.


19. Prices subject to change without prior notice.


20. Gerda Gesondheid (Gerda Timms- Rossouw) shall not be held liable for any loss, expense, inconvenience or breakage caused by negligence of the Courier Service.


21. We have no control over the Courier service and cannot be held responsible for losses, inconvenience or delays that are out of our control.


22. Do we have a 'money-back guarantee' policy? As all bodies are different, we understand that our products are not for everyone. If you do not like the taste of the product, or it doesn't "work" for you, no refund will be given. If you discover a sudden “allergy”, it is out of the control of Gerda Gesondheid, and due to the fact that you have opened and used the products, no refund can be given. Weight loss will differ from person to person. Weight loss will only be successful if instructions are followed 100% and the consumer does not have any undiagnosed condition, e.g. diabetes, underactive thyroid, etc. Certain medication (e.g. cortisone will also prevent weight loss). Due to these reasons, weight loss cannot be guaranteed.


23. Prior to purchasing our products, we recommend you read through our information provided. No refund or replacement will be facilitated it you do not like the products or taste, or if it doesn't “work" for you. ALL SALES ARE FINAL AND NON-RETURNABLE AND NON-REFUNDABLE. If the Buyer insists on buying products not suitable, the Seller cannot be held responsible for any side-effects or interfering with medical conditions or prescription medicine. Although the products are 100% natural, some herbs and spices might clash with certain medications or medical conditions, therefore the Buyer will be advised accordingly.


24. Return of products once sold will not be accepted.


25. The Seller couriers nationwide (South Africa ONLY) from Wolmaransstad.


26. Products are not available in stores, because it is an online mail order business via email or the online store. NO COLLECTION due to security reasons, delivery via courier ONLY. We work from a farm which is difficult to access.


27. Queries are answered via WhatsApp, Email or Facebook only, due to time contraints, as the Seller is handling the business alone. Consultations therefore done via WhatsApp, Email or Facebook only, NOT over the telephone.


28. Payments only accepted from South African Banks.


29. The Seller is not available for queries over weekends, only weekdays and during office hours.


30. Under NO CIRCUMSTANCES will it be allowed to fetch parcels at the Seller's workplace, products will be delivered via Courier. NO COLLECTION due to security reasons, and difficulty to access.


31. Please note: the Seller does not keep stock, we only work on orders.


32. The Seller’s main business is ONLINE MAIL ORDER, therefore NO COLLECTIONS ALLOWED.


33. After order and payment has been received, the Seller assumes that the Buyer has read and understands all the above, and will comply hereto. Once you tick the box labeled “I accept“, these Terms and Conditions of Sale form a legally-binding agreement between you and the Company.


34. Please note the term "Shipping" is used to describe the delivery service, as used by various large online shops, like Bid or Buy, Take-a-lot, Kalahari, etc, etc.


35. Products ONLY available in South Africa - CANNOT be sent to Namibia / overseas. PAYMENTS FROM SA BANKS ONLY. Cost to send to NAMIBIA STARTS AT R1500, documents to prove registration to export must also be provided, this registration costs roughly R60 000.


36. Payment allowed from SA banks ONLY. If payment from any bank outside of South Africa has been made, an admin fee of up to R500 will be charged, as a fine from the seller's bank.

If a refund has to be done as a direct cause of above, another fee of R100 will be charged. PAYMENTS FROM SA BANKS ONLY.  Refunds will take APPROXIMATELY 21 working days.


37. Please note delivery in SOME areas in SA not possible, eg Williston, Calvinia, Brandvlei, etc.


38. Privacy policy: The purposes for which we will use your personal information are as follows: to contact you regarding current or new products or services, to inform you of new features, special offers and promotional competitions (provided you have consented to receiving such marketing material), and to improve your experience on our Website by, inter alia, monitoring statistical non-personal browsing habits, and to transact with us. The Company will not use your personal information for any purpose (other than as stated above) without your express consent.
